Discussion on Enforcement of Constitutional Court's Ruling on Drug Use

On 13 November 2019, the Human Rights Education and Monitoring Center (EMC) held a discussion on "Ways to Enforce the Constitutional Court's Ruling of 2 August 2019 on Drug Use". The discussion was attended by representatives of the Constitutional Court, the Public Defender's Office and various NGOs.

Deputy Public Defender Giorgi Burjanadze presented a report during the discussion. The plaintiff in the case with regard to which the Constitutional Court made the 2 August 2019 ruling was the Public Defender of Georgia and the ruling resulted in the abolition of imprisonment and deprivation of liberty in certain cases of unlawful use and/or manufacture, purchase or possession of a small amount of narcotic drugs (other than marijuana).

In his speech, Giorgi Burjanadze touched upon the problems of the enforcement of the 2 August ruling, the practice of common courts and the challenges identified in this direction. The discussion made it possible to identify the areas with regard to which the Constitutional Court could be applied to in the future.
