Public Defender Responds to Verdict Delivered in Khorava Street Case

The Public Defender of Georgia has studied the verdict delivered against two juveniles in the case of murder committed on Khorava Street and came to a conclusion that the verdict clearly proves the deficiencies identified by the Public Defender in the investigation, due to which, the Prosecutor’s Office could not obtain and adduce sufficient evidence for convicting all persons involved in the murder of Davit Saralidze.

Tbilisi City Court delivered a guilty verdict on 31 May 2018 and completed to work on the full version of the verdict on June 14, where it grounded its decision. The Public Defender's Office fully studied the document and concluded that it is a justified verdict delivered in full compliance with the law.

The judgment contains quite detailed and comprehensive judgment. It analyzes the practice of the European Court of Human Rights and at the same time, all legal issues are decided in accordance with the practice of the Supreme Court of Georgia.

Tbilisi City Court's verdict of 31 May 2018 once again emphasizes the importance of effective investigation of all the details of the murder of juvenile Davit Saralidze. The Public Defender calls on the Ministry of Internal Affairs to carry out a quick and comprehensive investigation in order to identify all persons related to the crime, as well as the persons who prevented the proper investigation of the case.

The above-mentioned case clearly demonstrates the absence of an effective mechanism of protection of children from bullying and violence in school. It is clear that effective performance of duties by the individuals responsible for children's safety requires systematic reforms in order to minimize violence among juveniles and prevent such fatal cases in the future.
