Public Defender Responds to Case of Murder on Khorava Street

The thorough investigation of the murder of juveniles on Khorava Street and the execution of justice in this case represents a matter of special importance for the Public Defender.

G.J. was accused of knowingly committing, together with other persons, premeditated murder of juvenile Davit Saralidze, while G.B. was accused of attempted murder, committed by more than one person, of Davit Saralidze and premeditated murder, committed by more than one persons, of juvenile Levan Dadunashvili.

The court held that commission of the murder by more than one person had not been proved and it cleared both defendants of the mentioned aggravating circumstance of the murder. The court found G.J. guilty of only attempted murder of Davit Saralidze, since infliction of deadly wounds by him had not been proved; G.B. was found guilty of premeditated murder of Levan Dadunashvili, while he was acquitted of attempted murder of Davit Saralidze.

Based on the applicable legislation, the Public Defender can have access to the case materials only after the verdict is delivered. Consequently, in the nearest future, the Public Defender will examine the case materials that served as basis for delivering the mentioned verdict by the court.

According to the Public Defender, at this stage, the verdict delivered by the court strengthens the suspicions emerged after the tragedy that the investigation did not fully identified all the perpetrators of the murder of Davit Salaridze. Despite the fact that the victim’s party had been openly indicating the abovementioned circumstance during the investigation, no probe has been launched against other persons in relation to the murder and the Prosecutor's Office ruled out the involvement of other persons in the crime. The Public Defender urges the Prosecutor's Office to immediately launch a probe for identifying all persons involved in the crime. At the same time, the Public Defender emphasizes that grounds for launching a probe in this direction had existed earlier too, as according to the examination conclusion presented at the trial, Davit Saralidze's deadly wounds were not inflicted by the tool obtained by the investigation.

There are questions regarding the investigation of the cover-up of the crime and failure to report the crime as well, in particular, whether the list of persons charged with assisting the cover-up of the crime is full.

Due to high public interest, the Public Defender calls on the Prosecutor's Office to let her have access to all available investigation materials of the case. She also urges the Prosecutor's Office to immediately launch an investigation for identification of other persons involved in the murder and introduce the investigation materials to the Public Defender.
