Public Defender Files General Amicus Curiae Brief with Tbilisi Court of Appeal

Based on the appeals, the Public Defender’s Office examined Tbilisi City Court’s order of June 17, 2025, which granted the Anti-Corruption Bureau’s petition to request extensive information about one of the organizations and its activities.

As a result of examining the documentation received by the Office, it was revealed that when considering such petitions of the Anti-Corruption Bureau, the court deliberates on several rights issues, including the scope of interference in the sphere protected by freedom of association and the activities of human rights defenders; the rights of beneficiaries that are minors, persons with disabilities or victims of violence, including issues of protection of privacy and consideration of the best interests of the child.

Since such cases may also become the subject of consideration by the Court of Appeal in the future, and the implementation of the aforementioned supervisory mechanisms in practice is a novelty for the Georgian legal system, the Public Defender decided to submit a general amicus curiae brief to the court hearing the case on July 16, 2025. The general opinion amicus curiae brief serves to promote the establishment of appropriate legal standards and addresses all cases in which the court will have to consider similar factual circumstances.
