Tbilisi Enforcement Bureau Implements Recommendation Issued by Public Defender’s Office

The Public Defender of Georgia welcomes the decision of Tbilisi Enforcement Bureau, which fully implemented the recommendation of the Public Defender's Office and started forced enforcement proceedings against the National Agency of State Property LEPL in favor of one of our applicants.

As a result of the study of the case materials, it was found that Tbilisi Enforcement Bureau was unwilling to launch proceedings to reclaim the lost earnings of G.B., as it believed that the obligation to reclaim the lost earnings would arose only after the illegally dismissed person (creditor) was reinstated in the job specified by the court.

The Public Defender’s Office of Georgia considered that such an approach of the Bureau was not justified, did not correspond to the goal of the enforcement system and considered only the interests of the debtor party.

The Public Defender’s Office of Georgia emphasized in the recommendation that Tbilisi Enforcement Bureau had to immediately start the forced enforcement process to reclaim lost earnings from the National Agency of State Property, and prior to the reinstatement, during the enforcement proceedings, to reclaim the lost earnings from the debtor at specified intervals in accordance with the creditor's request. Tbilisi Enforcement Bureau fully implemented the recommendation of the Public Defender’s Office of Georgia.
