Public Defender Submits Comments on State Report on Implementation of European Social Charter

On June 30, 2022, the Public Defender of Georgia submitted comments (written contribution) to the European Committee of Social Rights on the 15th National Report of the Government of Georgia on the Implementation of the European Social Charter.

The 15th National Report of the Government of Georgia concerns the 3rd labour rights thematic group of the European Social Charter. In particular, the report reviews the measures taken to ensure the exercise of the following rights:

  • Proper conditions at work
  • Fair remuneration
  • Right to organize
  • Right to bargain collectively
  • Provision of information and consultation
  • Participation in defining and improving working conditions and working environment
  • Right to dignity at work
  • Right of the representatives of employees to protection and provision with appropriate equipment
  • Right to information and consultation in cases of collective dismissal

The comments of the Public Defender alternatively assess the measures taken by the Government to ensure some of the above rights. It also answers some of the questions asked by the European Committee of Social Rights to the Charter Member States about the above-mentioned rights protected by the Charter.

The European Social Charter is a Council of Europe treaty guaranteeing fundamental social and economic rights. The rights enshrined in the Charter apply to each person, to his or her daily life, employment, housing, health, education, social protection and welfare.

According to the procedure for reporting on the implementation of the European Social Charter, Member States shall submit an annual report to the European Committee of Social Rights on their activities. The Charter is divided into four thematic sections and each reporting year covers the rights of a specific direction. This year, the European Committee of Social Rights will review national reports on the implementation of the provisions of the Social Charter relating to the protection of labour rights and will issue a report, where it will evaluate the fulfillment of obligations by the States.
