Public Defender Addresses Parliament with Recommendation regarding the Conclusion and Recommendations of Fact-finding Commission Investigating the Murder of Two Juveniles on Khorava Street

On 19 September 2018, the Public Defender recommended the Parliament of Georgia that its resolution, which was adopted in connection with the fact-finding commission’s report and recommendations concerning the murder of two juveniles on Khorava Street, reflect, among other issues, the fact-finding commission’s recommendations regarding: 1. The launch of an investigation into alleged malfeasance and against the persons who improperly influenced the investigation; 2. The launch of criminal proceedings against M.K. for his involvement in the murder.

The Public Defender appealed to the Chief Prosecutor back in July and demanded the launch of an investigation into alleged malfeasance, as she considered that the questioning of persons, who were responsible for the investigation, by the commission proved that the investigative actions, which had been delayed or not conducted at all, did not serve any specific investigation tactics. Besides, the factual findings of the commission showed that there had been communication between the employees of the investigative bodies and close relatives of the participants of the investigation.

The commission also obtained additional evidence, which, together with earlier evidence existing in the case, created grounds for assuming that M.K. was involved in the murder. It should be noted that the mentioned circumstances had not been studied or evaluated by the investigative bodies. The Public Defender considers that the Parliament of Georgia should obligate the investigative bodies to investigate the factual circumstances identified by the commission.
