Meeting on Law on Wiretapping

The Public Defender of Georgia considers that the legislative amendments adopted by the Parliament on March 22, 2017, according to which, the technical means of wiretapping still remains in the State Security Service, is contrary to the Constitutional Court's decision of April 14, 2016. With regard to this issue, the Public Defender will appeal to the Constitutional Court in the coming days and will demand declaration of the new legislation regulating wiretapping as unconstitutional in a simplified procedure.

The Constitutional court reviews a case in a simplified procedure if a norm, which has the same content as the normative act declared unconstitutional by it, is adopted, and accordingly if its decision is overridden.

Public Defender Ucha Nanuashvili and First Deputy Public Defender Natia Katsitadze met with representatives of the NGOs involved in the campaign - This Affects You, which are going to file a constitutional suit with regard to the same issue.

It should be noted that the Public Defender enjoys independent constitutional authority to apply to the court and demand declaration of a normative act unconstitutional, when it, in his view, is contrary to the constitutional human rights. Accordingly, at the meeting with non-governmental organizations, it was decided that the Public Defender will independently use this competence, though since the subject of cases will be common, most likely, the Constitutional Court will combine the cases and review them as a single case.

The Public Defender and the NGOs agreed to cooperate in the future too.
