Public Defender’s Statement on Detention of Protesters outside Tbilisi City Council Building

The Public Defender of Georgia urges the state agencies not to hinder their representatives in performing their powers granted by the constitution and law of Georgia.

On October 10, 2017, Tbilisi main police department did not provide information requested by representatives of the Public Defender of Georgia about the whereabouts of participants of the protest held in front of Tbilisi City Councilbuilding, due to which, meeting with the detainees was artificially delayed for more than 3 hours.

According to the Public Defender of Georgia, unfortunately, this is not the first case when the employees of the Ministry of Internal Affairs of Georgia fail to cooperate quickly and effectively with representatives of the Public Defender of Georgia and impede the realization of their authority to immediately meet with the detained persons without reasonable, legitimate reasons.

Pursuant to the constitution of Georgia, creation of obstacles to the activities of the Public Defender is punishable by law, while in accordance with the Code of Administrative Offenses of Georgia, non-fulfillment of the Public Defender's legal request is administrative violation. In addition, the Public Defender and his representatives are authorized to request immediate provision of information and explanations from the state agencies, though the request was not fulfilled in this particular case.
