The Public Defender’s recommendation to the Minister of Internally Displaced Persons from the Occupied territories, Accommodation and Refugees

In accordance with Paragraph B of Article 21 of the Organic Law of Georgia on the Public Defender of Georgia, the Public Defender has addressed the Minister of Internally Displaced Persons from the Occupied Territories, Accommodation and Refugees of Georgia with a recommendation to study the condition of Irakli Gadelia, take into account the health condition of his son, Mikheil Gadelia, and the conditions necessary for his treatment, and take the necessary measures to create adequate living conditions for Irakli Gadelia’s family.

The Public Defender of Georgia received an application of Irakli Gadelia who is an IDP from Abkhazia. He, together with his family, is registered as required by law and lives in the building of the Republican Hospital in Zugdidi.

According to the applicant, his living conditions are extremely hard. The roof and walls of the building are damaged, which poses a threat to the life and health of the members of I. Gadelia’s family. In addition, in accordance with the submitted documents, Irakli Gadelia’s son, Mikheil Gadelia, has health-related problems. Specifically, the medical certificate confirms that Mikheil Gadelia is ill with acute lymphoid leukemia.

In connection with the aforementioned problem, Irakli Gadelia has applied the Ministry of Internally Displaced Persons from the Occupied Territories, Accommodation and Refugees of Georgia on several occasions. In spite of this, Irakli Gadeila says that he still does not have any concrete information connected with providing him with accommodation.

On March 1 and 29, 2012, the Office of the Public Defender’s Office of Georgia addressed the Ministry and, in accordance with Paragraph C of Article 18 of the Organic Law of Georgia on the Public Defender of Georgia, requested detailed information about providing Irakli Gadelia with alternative accommodation or rehabilitating his accommodation.

According to the information provided by the Ministry of Internally Displaced Persons from the Occupied Territories, Accommodation and Refugees of Georgia, the Ministry possesses information about the emergency condition of the building of the Republican Hospital in Zugdidi, due to which the issue of the IDPs living in the aforementioned building is paid particular attention and procedural monitoring on their long-term accommodation is under way.

In spite of this, the Ministry of Internally Displaced Persons from the Occupied Territories, Accommodation and Refugees of Georgia has not provided the Public Defender’s Office with concrete information about the terms within which Irakli Gadelia’s family will be provided with long-term accommodation.
