Public Defender of Georgia Demands Correction of Condition of Cultural Heritage Monument

On August 16, 2017, the Public Defender of Georgia addressed the National Agency for Cultural Heritage Preservation of Georgia (legal entity of public law) and the Supervision Service of Tbilisi City Hall with a recommendation to take measures within law for the correction of the condition of a monument of cultural heritage located on 111 Uznadze str, Tbilisi.

According to citizen N.T., one of the LLCs conducted unauthorized reconstruction of the monument of cultural heritage, which caused damage to the mentioned monument and its damaged foundation threatens constructive stability of the entire building.

As a result of studying the case materials, it was established that the measures taken by the Supervision Service of Tbilisi City Hall and the inaction of the National Agency for Cultural Heritage Preservation contradicts the requirements of the law. In particular, the acts issued by the Supervision Service were not aimed at eradicating the violation and correcting the damage caused to the monument, while the National Agency for Cultural Heritage Preservation of Georgia, in spite of its obligations and powers, did not respond to the case in accordance with the law.

The Public Defender of Georgia urges the National Agency for Cultural Heritage Protection to take measures under Article 88 of the Administrative Offenses Code of Georgia to eradicate the violation committed by the company and improve the condition of the cultural heritage monument.

The Public Defender of Georgia once again emphasizes the fundamental importance of cultural values ​​for the spiritual, cultural and social development of the human being. The main criterion for the protection of cultural values ​​is to maintain its authenticity and the crucial importance in this process is played by the state mechanisms, principles and quality of protection of cultural heritage. The state is the main guarantor for the protection of historically established environment - cultural heritage and, therefore, it is extremely important authorized bodies to carry out timely, adequate and effective measures in each case of infliction of damage to a cultural heritage monument.
