Recommendation to the Minister of Corrections

On August 1st 2014, Public Defender of Georgia addressed the Minister of Corrections of Georgia with the recommendation to ensure the realization of the right to free movement of prisoners on the territory of penitentiary institution, who are placed in the penitentiary institution N6 and serve the sentence in the semi-open type penitentiary establishment.

Formally, penitentiary institution N 6 is a semi-open and closed type penitentiary establishment, however is has no infrastructural conditions necessary for semi-open type penitentiary establishment, therefore the prisoners cannot use one of the main rights of free movement on the territory of establishment set by the Prison Code. The realization of this right is important since the inmates have the possibility to be in the fresh air during the daytime.

According to the above mentioned, Public Defender of Georgia calls the Minister of Corrections of Georgia to take relevant measures for transferring the inmates serving a sentence in the semi-open type penitentiary institution to the appropriate semi-open type penitentiary establishments where they will be able to realize the rights guaranteed by the Legislation of Georgia. Since the penitentiary institution N6 has no appropriate infrastructure the Public Defender calls the Minister of Corrections not to place the prisoners who are sentenced in semi-open type penitentiary establishment in the penitentiary institution N 6.
