Report on the Fulfillment of Recommendations/Proposals Issued by the Public Defender of Georgia in 2014

On January 23, 2015, the Public Defender of Georgia presented a study on realization of recommendations and proposals issued by the Public Defender in 2014. The presentation was attended by representatives of the Government and the Parliament of Georgia, international diplomatic corps accredited in Georgia, international organizations and the media.

The report encompasses not only statistical but also qualitative indicators of realization of recommendations/proposals that were issued by the Public Defender to various bodies. When noting qualitative indicators of realization of recommendations/proposals, the Public Defender implies such criteria as realization timeframe, fact of reinstatement of a violated right, effectiveness and outcome of conducted activities.

In 2014, the Public Defender sent 154 recommendations and proposals to various agencies – bodies of central and local authorities, as well as officials. Out of these only 35 (23%) were realized, 22 (14%) were partially fulfilled, 47 (31%) - not realized and no response received in case of 28 (18%).

Last year, the largest number of recommendations/proposals was sent to the Chief Prosecutor of Georgia, out of which 8 have not been fulfilled and 9 were left unanswered. It should be noted that the absolute majority of the recommendations/proposals addressed to the Chief Prosecutor’s Office of Georgia and were left unanswered concerned request of launch of an investigation on various violations, namely, ill-treatment, illegal depravation of liberty, actions of law enforcers, etc.

According to the study, realization of recommendations/proposals by effectiveness was distributed as follows: full result achieved in 15 (11%) cases (recommendation was taken into account and a violated right was reinstated), no results achieved in 82 (63%) cases (recommendation was not taken into consideration and a violated right was not reinstated), the Public Defender received a promise on fulfillment in 18 (14%) cases, court proceedings are under way for 4 (3%) cases and partial reinstatement of a violated right took place in 12 (9%) cases.

19 recommendations/proposals issued by the Public Defender in 2014 were transferred to another agency and only in 2 cases an answer was received, 5 recommendations/proposals were fulfilled and 8 were not fulfilled.

The report covers all the recommendations/proposals that were sent to various agencies from 01 January 2014 to 31 December 2014 period of time.

Presented report includes not only the quantitative statistics of the fulfillment of recommendations/proposals issued by the Public Defender of Georgia, but the qualitative indicators as well. While designating the qualitative ratio of fulfillment, Public Defender descants the criteria such as fulfillment timing, restoration of the infringed right, effectiveness of the taken measure and the outcome.
